Article 1 (Purpose and Effect of the Terms)
These Terms of Service (hereinafter referred to as the ¡°Terms¡±) are intended to define the basic matters concerning the rights, obligations, and responsibilities between Viewtel Co., Ltd. (hereinafter referred to as ¡°Viewtel¡±) and users in connection with the use of various glucose monitoring system products and related services provided by Viewtel through wired and wireless Internet.
By selecting the ¡°Agree¡± button to these Terms as notified by Viewtel, users are deemed to have expressed their consent to these Terms and may use the Viewtel services.
Accordingly, users are advised to review these Terms and related operating policies carefully.
The contents of these Terms may be reviewed at any time through the initial screen of each applicable service while using the Service.
Details regarding Viewtel¡¯s efforts to safely process users¡¯ personal information and other matters related to personal information protection are provided in Article 13 (Protection of Users¡¯ Personal Information and Sensitive Information) of these Terms and in the Viewtel Glucose Monitoring Service Privacy Policy (http://view-tel.co.kr/default/policy/privacy.php).
Article 2 (Definitions)
- The terms used in these Terms shall have the following meanings:

¡°Service¡± means all services that users may use, including information search, measurement, monitoring, and communication with other users, through websites and applications (Apps) operated under domains provided by Viewtel for glucose monitoring products and services, regardless of the type of device used (including PCs, mobile phones, and other wired or wireless devices).

¡°Member¡± means a person who has entered into an account use agreement with Viewtel pursuant to Article 5 (Use of Viewtel Service Accounts) by providing personal information and registering for the Service.

¡°Non-member¡± means a person who uses the Service provided by Viewtel without registering as a Member.
-
¡°User¡± collectively refers to both Members and Non-members who agree to these Terms and use the Service provided by Viewtel.

¡°Account¡± means a unique identification unit established to manage each Member¡¯s service usage history after logging into the Viewtel Service.
An ¡°Account ID¡± or ¡°ID¡± shall be defined in the form of an email address and used for identification and Service use.
A ¡°Password¡± means the credential used to verify that the user corresponds to the registered ID and shall consist of a combination of at least eight (8) characters, including letters, numbers, and special characters, as determined by the Member.
Members may link their Viewtel Account with external account services (such as Google, Apple ID, or Kakao) that use an email-based ID, in which case a separate password is not required.

¡°Personal Information¡± and ¡°Sensitive Information¡± mean personal information and sensitive information as defined under the Personal Information Protection Act of the Republic of Korea and other applicable laws of the countries where Viewtel Services are provided.

¡°Membership Withdrawal¡± means termination of the account use agreement by a Member in accordance with Article 8 (Termination of Account Use Agreement and Restrictions on Use).

Any terms not defined in Paragraph 1 of this Article shall be interpreted in accordance with relevant laws, individual service notices, or, if not specified therein, general commercial practices.
Article 3 (Notice and Amendment of the Terms)

Certain services provided by Viewtel or affiliated services provided by third parties (hereinafter collectively referred to as ¡°Individual Services¡±) may be governed by separate terms and conditions applicable to each Individual Service.
The terms applicable to such Individual Services may be disclosed through the initial screen of the relevant service or other publicly announced methods.
In the event that the terms applicable to an Individual Service conflict with these Terms, the terms applicable to the Individual Service shall prevail.

Viewtel shall disclose these Terms, its address, trade name, name of its representative, and the name of the person responsible for personal information protection at the time users first use the Service, and thereafter shall make such information easily accessible within the Service so that users may readily understand their rights.

Viewtel may amend these Terms to the extent permitted by applicable laws.
If these Terms are amended, Viewtel shall notify users of the amended content through the initial screen of the Service or a notice board at least seven (7) days prior to the effective date of the amendment.
However, if the amendment is unfavorable to users, Viewtel shall provide notice at least thirty (30) days in advance and shall notify Members individually.

Users are obligated to review notices or notifications regarding amendments to these Terms.
Viewtel shall not be liable for any damages incurred by users as a result of amendments to the Terms or due to a user¡¯s failure to become aware of the amended Terms through the user¡¯s own negligence.

If Viewtel clearly notifies users that failure to express an objection from the date of notice until the effective date of the amendment shall be deemed acceptance, and the user does not expressly object, the user shall be deemed to have agreed to the amended Terms.

If a user does not agree to the amended Terms, Viewtel may be unable to continue providing the relevant Service governed by the amended Terms.
Article 4 (Notice to Users)

Viewtel may provide notices to users via email, text messages (SMS/MMS), application notifications (push notifications), or other appropriate communication methods.

In cases where individual notice to an unspecified number of users is impracticable, Viewtel may substitute individual notice by posting the relevant information on a Service notice board or similar medium for at least thirty (30) days.
However, matters that may cause disadvantage to users or have a significant impact on users¡¯ rights or transactions shall be publicly announced, and Members shall be notified individually.
Article 5 (Use of Viewtel Service Accounts)

An account use agreement for a Viewtel Service account (hereinafter referred to as the ¡°Account Use Agreement¡± or ¡°Membership¡±) shall be formed when a user agrees to these Terms, completes the identity verification procedures prescribed by Viewtel, provides certain personal information, and submits an application for membership, and Viewtel accepts such application.
In principle, Viewtel shall accept applications for membership; however, Viewtel may suspend or refuse acceptance in any of the following cases until the relevant issue is resolved:
- Where the applicant uses another person¡¯s information or provides false information when applying for membership;
- Where the applicant is under fourteen (14) years of age;
- Where a user who has previously been subject to service suspension or other sanctions for violating these Terms or applicable laws applies for re-registration prior to the lifting of such sanctions;
- Where the application violates, or is likely to violate, these Terms or applicable laws;
- Where Viewtel deems it necessary to temporarily suspend the creation of accounts due to business or technical reasons.

Unless otherwise specified, Paragraph 1 of this Article shall apply mutatis mutandis to Individual Services provided by Viewtel or third parties.

Member identity verification is conducted via the email address registered to the Account.
Accordingly, maintaining accurate and up-to-date account information is essential for uninterrupted use of the Service.
If any registered information changes, Members must log in to the Service and update such information.
Any disadvantages arising from a failure to notify Viewtel of such changes shall be borne by the Member.

Members may not allow any third party to use their Account.
An Account is an identification unit established to manage each Member¡¯s usage history of Viewtel Services.
Unless special circumstances exist, any activity performed while logged into an Account shall be deemed to have been conducted by the relevant Member.
Accordingly, Members may not sell, transfer, lend, or provide their Account as collateral, nor permit any third party to use it.

Users are advised that impersonating a Member or using the Service as though one were a Member without authorization may cause unforeseen damage to other users or to Viewtel.
Any resulting harm or adverse consequences shall ultimately be borne by the Member who permitted such unauthorized use.
Article 6 (Changes to Member Information)

Members may review and modify their personal information at any time through the personal information management screen.
However, certain information required for service management, such as ID, date of birth, real name, and gender, may not be modified.

As stated in Article 5 (Use of Viewtel Service Accounts), if any information provided at the time of membership registration is changed, Members must update such information online or notify Viewtel of the change via email or other methods.

Viewtel shall not be liable for any disadvantages incurred due to a Member¡¯s failure to notify Viewtel of changes pursuant to Paragraph 2 of this Article.
Article 7 (Obligation to Manage Member IDs and Passwords)

Members shall ensure that only the Member himself or herself logs into and uses the Account.

Members are responsible for managing their Account ID and password and shall not permit any third party to use them.

If a Member becomes aware that his or her ID or password has been stolen or is being used by a third party, the Member shall immediately notify Viewtel and follow Viewtel¡¯s instructions.

Viewtel shall not be liable for any disadvantages arising where the Member fails to notify Viewtel of such facts or fails to comply with Viewtel¡¯s instructions after notification.

Viewtel may restrict the use of an ID if it is deemed likely to result in personal information leakage, is contrary to public order or morals, or may be mistaken for Viewtel or its operators.

If abnormal login activity is detected, Viewtel may implement protective measures to restrict access to the Account.
Such measures may be taken where suspicious activity is identified, including but not limited to excessive login attempts, frequent alternation between domestic and overseas access, or mass posting of illegal or commercial content, suggesting possible compromise of the Account.
Article 8 (Termination of Account Use Agreement and Restrictions on Use)

Members may request termination of the Account Use Agreement at any time (hereinafter referred to as ¡°Termination¡± or ¡°Membership Withdrawal¡±), and Viewtel shall process such requests promptly in accordance with applicable laws.
Membership Withdrawal may be completed through the Viewtel account management website (https://accounts.view-tel.co.kr).

Upon Membership Withdrawal, all Member data shall be deleted, except where retention is required under applicable laws or where retention is necessary for legitimate business purposes in accordance with the Privacy Policy.

Where a user has not logged in or accessed the Service for a certain period of time, Viewtel may notify the user in advance via email, in-service notification, or other appropriate electronic means and thereafter delete or separately store the user¡¯s information.
If such action results in insufficient information required for service provision, Viewtel may terminate the Account Use Agreement pursuant to this Article.

Viewtel may impose staged restrictions on service use, including warnings, temporary suspension, or permanent suspension, if a Member falls under any of the following circumstances:
- Providing false information during membership registration or in posts on Service-provided bulletin boards;
- Posting content that defames or slanders a third party, including individuals or legal entities;
- Posting content that includes verbal abuse toward Viewtel employees or causes other forms of psychological harm;
- Posting content that infringes upon the intellectual property rights or other rights of Viewtel or third parties;
- Posting content that interferes with the stable operation of the Service;
- Posting content that violates public order or good morals;
- Using the Service for criminal purposes;
- Interfering with other users¡¯ use of the Service;
- Intentionally disrupting Service operations or transmitting advertising or spam messages contrary to recipients¡¯ express refusal;
- Any other conduct that violates these Terms or applicable laws, or is otherwise deemed by Viewtel to have reasonable grounds for restriction.

Notwithstanding the foregoing, Viewtel may immediately and permanently suspend an Account where the Member violates applicable laws, including but not limited to identity theft or payment fraud under the Resident Registration Act, provision or operation of illegal programs under the Copyright Act or Computer Program Protection Act, illegal communications or hacking under the Information and Communications Network Act, distribution of malicious programs, or unauthorized access.

Viewtel may restrict service use where a Member has not logged in for more than one (1) year, for the protection of Member information and operational efficiency.

When imposing restrictions under this Article, Viewtel shall notify the Member in advance of the reasons, type, and duration of the restriction, as well as the procedure for filing objections.
Members may file objections in accordance with Viewtel¡¯s prescribed procedures, and where such objections are deemed justified, Viewtel shall promptly restore service access.

Upon Membership Withdrawal pursuant to this Article, posts and comments created by the Member during Service use shall not be deleted.
Accordingly, Members are advised to delete such content prior to submitting a withdrawal request.
Article 9 (Use of the Service)

The Service shall, in principle, be available twenty-four (24) hours a day, except where service provision is impracticable due to business or technical reasons.
Viewtel may conduct maintenance or inspections as necessary, during which service availability may be temporarily restricted.
No compensation shall be provided for modifications, changes, or termination of free services, unless otherwise required by applicable laws.

Where Service content is upgraded, modified, added, or removed, Viewtel shall endeavor to notify users through the Service¡¯s initial screen or other appropriate means.
Users are encouraged to use the latest version of the Service, and Viewtel shall not provide compensation for service limitations arising from failure to do so, except as required by law.

Viewtel shall make reasonable efforts to provide timely guidance regarding matters necessary for Service use.
Notifications to Members may be provided individually or collectively via email, in-service notifications, or other electronic means, and may also be posted on the initial screen or notice board of the relevant website or application.

Users shall comply with these Terms, Service notices, and usage guidelines, and shall not engage in any of the following acts:
- Using the Service for commercial purposes without Viewtel¡¯s prior written consent;
- Unauthorized modification, extraction, duplication, reverse engineering, or similar acts involving the Service or related components;
- Intentional damage to the Service, overloading, or malicious use including distribution of malware or hacking;
- Any other acts that violate these Terms or applicable laws.
Article 10 (Suspension of Service and Notice of Suspension)

Viewtel shall not be liable for deletion or loss of personal information stored within the Viewtel Service resulting from national emergencies, failures of service facilities beyond Viewtel¡¯s control, or other force majeure events.

Where normal Service provision becomes impossible due to urgent system inspection, system expansion or replacement, natural disasters, or national emergencies, Viewtel may temporarily restrict or suspend the Service.
In such cases, Viewtel shall endeavor to minimize inconvenience by notifying Members in advance of the reason and duration of the suspension.
However, where suspension occurs due to causes beyond Viewtel¡¯s control (including system administrator intent, disk failure without negligence, system failure, or acts or negligence of third parties such as telecommunications providers or maintenance contractors), prior notice may not be possible and notice may be provided after the fact.

Where all or part of the Service must be permanently discontinued due to Viewtel¡¯s business judgment, such as replacement with a new service, Viewtel shall provide notice at least thirty (30) days in advance and shall notify Members individually.

If a user¡¯s Service use is immediately and permanently suspended due to a clear violation of applicable laws, all benefits obtained through the Service shall be extinguished and no separate compensation shall be provided.
In such cases, the user may file an objection, and where such objection is deemed justified, protective measures such as restoration may be implemented.

Viewtel may divide the Service into specific scopes and designate available service hours for each scope, in which case the relevant details shall be notified in advance.
Article 11 (Obligations of Viewtel)

Viewtel shall not disclose or distribute users¡¯ personal information or sensitive information obtained in connection with Service provision to third parties without the user¡¯s consent.
However, this shall not apply where disclosure is required by relevant authorities for investigative purposes in accordance with applicable laws or lawful procedures.

Viewtel shall endeavor to promptly repair or restore facilities and software to provide continuous and stable Services unless unavoidable circumstances exist.
However, in cases of natural disasters, emergencies, or other unavoidable events, Service provision may be temporarily suspended.
For changes or suspension of services provided by third-party partners, such as affiliated applications, users shall refer to the respective partner¡¯s terms and notices and contact such partners directly if necessary.

Viewtel shall make reasonable efforts to promptly address user complaints related to the Service and shall notify users of the reasons and expected processing schedule where prompt resolution is difficult.

Viewtel shall comply with applicable laws, including the Personal Information Protection Act of the Republic of Korea, the Communications Secrets Protection Act, and the Telecommunications Business Act, in operating and maintaining the Service.
Article 12 (Obligations of Users)

Where a user engages in any of the following acts, Viewtel may delete the relevant content or restrict Service use for a certain period.
Except in cases of Viewtel¡¯s intentional or negligent conduct, the user shall be liable for damages incurred by Viewtel as a result:
- Providing false information during membership registration or posting false information on Service bulletin boards;
- Posting content that defames or slanders a third party, including individuals or corporations;
- Posting content that includes verbal abuse toward Viewtel employees or causes psychological harm;
- Posting content that infringes upon intellectual property rights or other rights of Viewtel or third parties;
- Posting content that interferes with the stable operation of the Service;
- Posting content that violates public order or good morals;
- Using the Service for criminal activities;
- Interfering with other users¡¯ use of the Service;
- Intentionally obstructing Service operations, transmitting information that disrupts Service stability, or transmitting advertising or spam messages contrary to recipients¡¯ express refusal;
- Any other acts that violate these Terms or applicable laws, or which Viewtel reasonably determines to warrant restriction.

Where measures such as content deletion or Service suspension are imposed pursuant to the preceding paragraph, Viewtel shall notify the user in advance of the reasons, type, and duration of the restriction, as well as the procedure for filing objections.
Where an objection is deemed justified, Viewtel shall promptly restore the content or resume Service use.

Users shall not engage in hacking, decompiling, reverse engineering, illegal distribution of commercial software, or other prohibited activities.
Viewtel shall not be liable for consequences arising from such violations, and users shall be subject to legal measures and shall be liable for damages incurred by Viewtel.

Data sharing and download functions provided within the Service are used at the user¡¯s discretion, and responsibility for such use rests solely with the user.
Article 13 (Protection of Users¡¯ Personal Information and Sensitive Information)

Viewtel places great importance on protecting users¡¯ personal information and shall endeavor to protect such information in accordance with applicable laws, including the Personal Information Protection Act of the Republic of Korea.

Users¡¯ personal information shall be collected and used only to the minimum extent necessary for smooth Service provision.
Service-related notices or marketing information may be transmitted to users¡¯ contact information within the scope consented to by the user.
Further details regarding the protection and processing of personal information are set forth in the Personal Information Processing Policy
(https://view-tel.co.kr/default/policy/en/privacy.php), which is separately posted and made easily accessible to users through Service menus or other appropriate means.
Article 14 (Attribution of Rights)

Copyrights and intellectual property rights related to the Service belong to Viewtel.

Copyrights and other intellectual property rights of third-party works provided under partnership agreements shall belong to the respective providers, unless otherwise stipulated in the relevant agreements.

All Services, information, and materials provided by Viewtel are assets owned by Viewtel or used by Viewtel under lawful rights and are protected under applicable laws.
Even where such information or materials are cited for non-commercial purposes other than Service provision, a separate written agreement with Viewtel is required, and the source must be clearly indicated.
Without such permission, copying, modification, reproduction, distribution, publication, exhibition, transfer, sale, or use of such information or materials to create tangible or intangible products or services is strictly prohibited.

Even where users are permitted to use Viewtel¡¯s information or materials pursuant to a written agreement under the preceding paragraph, disclosure or provision to third parties other than the contracting parties is prohibited in principle.
Violation of this provision shall result in liability for damages.

Where users agree to and comply with these Terms, Viewtel grants users a non-exclusive, revocable, non-transferable, and non-sublicensable limited license to use the Service (including Service software) solely for the purpose of using the Service (the ¡°Service License¡±).
Users may not transfer or permit reuse of the Service License.
Users acknowledge and agree that the Service License grants only a right to use the Service during the Service period and does not transfer ownership or any intellectual property rights.
This Service License does not apply to Viewtel¡¯s names, brands, or logos, all of which remain the exclusive property of Viewtel and are protected by applicable laws.
Article 15 (Disclaimer)

Where a user suffers damage due to use of the Service, Viewtel shall be liable only to the extent such damage is directly attributable to Viewtel¡¯s fault.
Viewtel shall not be liable for damages arising from the following causes where there is no intent or negligence:
¨ç Natural disasters or force majeure events;
¨è Service disruption attributable to the user;
¨é Losses or damages resulting from inability to use the Service;
¨ê Profits or losses arising or expected to arise from information or data obtained through the Service;
¨ë Responsibility for user-generated content or disputes between users and third parties through the Service or its platform;
¨ì Any other damages permitted to be excluded under applicable laws.

Factual or legal defects in the Service, including but not limited to defects related to safety, reliability, accuracy, completeness, validity, fitness for a particular purpose, security, errors, bugs, or infringement of rights, may occur without Viewtel¡¯s fault.
Viewtel shall not be liable for such defects unless caused by intent or negligence.

Information provided through the Service is for reference only and shall not replace medical diagnosis, treatment, or care.
Use of such information is entirely at the user¡¯s discretion, and Viewtel shall not be liable unless there is intent or gross negligence.

The Service may include products or services provided by third parties through business partnerships, and responsibility for such products or services rests with the respective third parties.

Even in cases under the preceding paragraph, Viewtel shall not be liable for indirect, special, or consequential damages arising from breach of obligation or tort due to Viewtel¡¯s negligence (excluding gross negligence), including cases where such damages were foreseeable.
Article 16 (Compensation for Damages)
Where a user reproduces, discloses, provides, or uses all or part of the Service or its accompanying elements for purposes other than those permitted under these Terms, or violates user obligations under these Terms, Viewtel may claim compensation for any resulting damages.
Article 17 (Governing Rules Outside These Terms)
Matters not stipulated in these Terms and interpretation of these Terms shall be governed by individual service terms or applicable laws, and where not specified by law, by general commercial practices.
Article 18 (Governing Law and Dispute Resolution)

These Terms are written in Korean as the authoritative version.

The laws of the Republic of Korea shall govern the relationship between users and Viewtel in connection with these Terms and the Service.

Disputes arising between users and Viewtel in connection with use of the Service or these Terms shall, in principle, be resolved through mutual consultation.
Where such resolution is not possible, disputes shall be subject to the jurisdiction determined in accordance with the Civil Procedure Act of the Republic of Korea.
¡á Supplementary Provision
Article 1 (Effective Date)
These Terms shall take effect as of October 1, 2024.
