Article 1 (Purpose and Effect of Terms and Conditions)

This Terms and Conditions of use (hereinafter referred to as the "terms and conditions") aims to set basic matters concerning rights, obligations and responsibilities between Viewtel Co., Ltd (hereinafter referred to as the "Viewtel") and users in using various glucose monitoring system products and services using wired and wireless Internet provided by Viewtel. By selecting the 'I agree' button to these terms and conditions notified by Viewtel, you will be able to express your consent to these terms and conditions and use the Viewtel service, so please carefully review these terms and conditions and related operating policies. The contents of these terms and conditions can be found on the initial screen of each applicable service even while using the service. Details of Viewtel's efforts to safely process users' personal information and other personal information protection can be found in Article 13 of the terms and conditions (Protecting users' personal Information and sensitive information) and the Viewtel glucose monitoring system service personal information processing policy (https://view-tel.co.kr/default/policy/en/privacy.php).

Article 2 (Definition of Terms)

  1. The terms used in these Terms and Conditions are defined as follows.
    ¨ç The term ¡®service¡¯ refers to a variety of services available to users, such as information search, measurement, monitoring, and communication with other users through the Web site and application (App) of the domain provided by Viewtel for glucose monitoring systems and services, regardless of terminals (including various wired and wireless devices such as PCs, mobile phones, and portable terminals).
    ¨è The term ¡®member¡¯ means a person who has entered into an account use contract with Viewtel pursuant to Article 5 (use of Viewtel service accounts) to provide personal information to Viewtel and to use the service.
    ¨é ¡®Non-member¡¯ refers to a person who does not register as a member and uses the services provided by Viewtel.
    ¨ê The term ¡®user¡¯ refers to a person who agrees to these terms and conditions and uses the services provided by Viewtel, collectively, as ¡®members¡¯ and ¡®non-members¡¯.
    ¨ë The term ¡®account¡¯ refers to a member identification unit set up to manage various service history used by members after they log in to the Viewtel service, and the term ¡®account ID¡¯ or ¡®ID¡¯ should be defined in the form of an e-mail for members to identify members and use the service. The term ¡®account password (PASSWORD)¡¯ or ¡®PASSWORD¡¯ refers to confirming that a member matches the ¡®ID¡¯ set by the ¡®member¡¯, and confidentiality refers to a combination of at least 8 characters, numbers, and special characters determined by the member himself. Members can link Viewtel accounts through external account services (e.g., Google accounts, Apple IDs, Kakao accounts, etc.) that use e-mail-type IDs in setting ¡®accounts¡¯, and in this case, no password is given separately.
    ¨ì ¡®Personal information¡¯ and ¡®sensitive information¡¯ refer to ¡®personal information¡¯ and ¡®sensitive information¡¯ under related laws such as the Korea Personal Information Protection Act and similar laws in countries where Viewtel services are provided.
    ¨í ¡®Membership withdrawal¡¯ means that the member terminates the account use contract in accordance with Article 8 of this terms and conditions (cancellation of account use contract and restrictions on use, etc.).
  2. The terms used in these terms and conditions that are not specified in paragraph 1 shall be in accordance with the relevant statutes and the individual service guidance, and otherwise in accordance with general and commercial practices.

Article 3 (Notification and Change of Terms and Conditions)

  1. Some services provided by Viewtel or affiliated services provided by a third party (hereinafter collectively referred to as "individual services") may be classified for each individual service, or separate terms and conditions may be applied. The terms and conditions of use of these individual services can be checked through other known methods such as the initial screen of the service. If the contents of the terms and conditions of use of the individual services agreed by the user conflict with the contents of these terms and conditions, the terms and conditions of use of the individual services will take precedence.
  2. Viewtel notifies users of the terms and conditions, address, trade name, name of representative, name of personal information protection manager, etc. when using Viewtel's service for the first time, and then easily marks and posts them within the service so that users can know their rights well.
  3. If necessary, Viewtel may amend these terms and conditions to the extent that they do not violate the relevant laws and regulations, and if there is an amendment to these terms and conditions, Viewtel will notify the change through the initial screen or notice board of the Viewtel service seven days before the effective date of the change. However, if the change is made to be unfavorable to the user, the user will be notified 30 days in advance, and the members will be notified individually.
  4. Users are obligated to check the company's announcement or notification regarding the change of the terms and conditions, and the company is not responsible for the damage caused by the change of the terms and conditions and the damage caused by the user's negligence not knowing the contents of the revised terms and conditions.
  5. Even though Viewtel has clearly announced that it is considered approved unless user expresses his/her intention to reject the change from the date of notice to the effective date of the change, if there is no user's expression of intention, it is deemed that the user has agreed to the changed terms and conditions.
  6. If the user does not agree to the changed terms and conditions, it may no longer be possible to provide such services subject to the changed terms and conditions.

Article 4 (Notification to Users)

  1. Beutel can notify users by email, text message (SMS/MMS), sending application notification (Push Notification Service; PNS), and other appropriate means of communication.
  2. In the case of notification to a large number of unspecified users who cannot be notified under the preceding paragraph, Viewtel may substitute for individual notification by posting the relevant information on the service bulletin board, etc. for 30 days. However, the contents that are disadvantageous to the user or matters that have a significant impact on the user's own transaction shall be notified, and the members shall be notified individually.

Article 5 (Use of Viewtel Service Accounts)

  1. The account use contract for the use of the Viewtel service member account is concluded by the Viewtel when the user agrees to the terms and conditions, completes the self-authentication process set by Viewtel, provides certain personal information, and applies for membership (referred to as "account use contract" or "membership"). In principle, Viewtel approves the user's subscription, but in the following cases, consent may be reserved or not accepted until the reason is resolved.
    ¨ç Where a user steals other person's information or applies for membership by stating false information
    ¨è If the user is under 14 years of age
    ¨é In the event that a user who has been sanctioned by Viewtel for suspension of service use, etc. in violation of these terms and conditions or laws voluntarily applies for re-registration prior to the lifting of the sanctions
    ¨ê If it violates these terms and conditions or If there is a risk of violating these terms and conditions or laws
    ¨ë Where it is deemed necessary to suspend the creation of a member account for a certain period of time due to the business or technical reasons of Viewtel
  2. Unless otherwise specified, this Article 5, Paragraph 1 shall apply to individual services provided by Viewtel or a third party.
  3. Members' identity verification is carried out through email registered in the account, so it is of utmost importance to keep this information up to date if you want to use Viewtel service without any inconvenience. If the information registered in the account changes, members must log in to the Viewtel service and modify it. Any disadvantages caused by not notifying Viewtel of the changes are to be borne by the members.
  4. You cannot have someone else use your account. An account is a member identification unit set up to manage members' history of using various Viewtel services for each member. If a member's account is logged in, it is considered that the member is logged in unless there are special circumstances, and various activities such as posting posts while logged in are also considered to be the member's use of the service unless there are special circumstances. Because the account is an identification unit exclusive to a particular member, the member may not sell, transfer, lend or provide his or her account as collateral to others, nor may he or she allow others to use it.
  5. Please note that using the Viewtel service as if you are an actual member, in spite of not being a member, will cause unexpected damage to other users you trust in normal membership activities or to Viewtel, and the resulting harm and side effects will eventually return to the member who allowed you to use the account.

Article 6 (Change of Membership Information)

  1. Members can view and modify personal information at any time through the personal information management screen. However, some information, such as ID, date of birth, real name, and gender, required for service management cannot be modified.
  2. As mentioned in Article 5 (Use of Viewtel Service Account) of this terms and conditions, if any changes are made in the information stated at the time of membership registration, members must modify them online or notify Viewtel of the changes by e-mail or other means.
  3. Viewtel is not responsible for any disadvantages caused by not notifying Viewtel of the changes in Article 6, Paragraph 2.

Article 7 (Obligation to Manage Members' IDs and passwords)

  1. Only members have to log in to their own account.
  2. Members are responsible for the management of their ID and password and should not let a third party use them.
  3. Members should immediately notify Viewtel and follow Viewtel's guidance if their ID and password are stolen or recognized by a third party.
  4. In the case of Article 7, Paragraph 3, Viewtel shall not be responsible for any disadvantages caused by the failure to notify or not complying with Viewtel's guidance even if the relevant member notifies the fact.
  5. Viewtel may restrict the use of the ID if a member's ID is feared to leak personal information, is contrary to anti-social custom or social moral, or is mistaken for the operator of Viewtel or Viewtel.
  6. If it is judged to be an abnormal login, ID protection can be inevitable. Viewtel can take ID protection measures to restrict the login of the member if it is suspected that the member's ID and password have been leaked outside due to abnormal login history, such as having a large number of access to the member's account, frequent interchange of domestic and foreign access, or a large number of illegal or commercial posts.

Article 8 (Cancellation of Account Use Contracts and Restrictions on Use, etc.)

  1. Members can apply to Viewtel at any time to terminate their account (referred to as "Cancellation of Account Agreement" or "Membership Withdrawal") and Viewtel will expedite this process as required by relevant laws and regulations. Membership withdrawal can be done on the Viewtel account management website (https://accounts.view-tel.co.kr).
  2. In the event of a member's withdrawal, all data of the member will be deleted, except when Viewtel holds the member's information in accordance with relevant laws and privacy policies and when necessary for due processing.
  3. Viewtel may destroy or separate the user's information after notifying by e-mail, notification within the service, or other appropriate electronic means if the user has not logged in or accessed for a certain period of time to use the service. If this results in a lack of essential information to provide the service, the account use contract may be terminated in accordance with this Article.
  4. Viewtel may limit the use of the service in stages by warning, suspension, permanent suspension, etc. if a member falls under any of the following subparagraphs.
    ¨ç Where false information is stated in the membership registration information or on the bulletin board provided by the service
    ¨è Where a post is written that slanders or defames a third party (including individuals and corporations)
    ¨é If it includes verbal abuse against Viewtel's employees or contents causing other psychological distress
    ¨ê Where a post infringing on the intellectual property rights and other rights of Viewtel and a third party is stated
    ¨ë Where a post interfering with the stable operation of the service is recorded
    ¨ì Where a post containing content that violates public order and social moral is entered
    ¨í When the service is used for criminal conduct
    ¨î In the case of obstructing the use of services by other users
    ¨ï The act of transmitting information that may intentionally interfere with the operation of Viewtel's services, or transmitting advertising spam information against the recipient's express refusal to receive the service
    ¨ð Any other violation of these terms and conditions or laws, or if Viewutel deems it to have reasonable grounds
  5. Notwithstanding the preceding paragraph, Viewtel may immediately suspend the account of its members permanently if it violates relevant laws, such as theft of title and payment in violation of the "Resident Registration Act", provision of illegal programs in violation of the "Copyrights Act" and "Computer Program Protection Act" and obstruction of operation, illegal communication and hacking in violation of the "Information and Communication Network Act", distribution of malicious programs, and act of exceeding access rights.
  6. Viewtel can restrict its use for the protection of its membership information and the efficiency of its operation if members continue not to log in for more than a year.
  7. In the event of measures such as restrictions on use under this Article, Viewtel will notify the members in advance of the reasons for the restrictions, the type and duration of the restrictions, and how to file an objection to the restrictions. Members may file an objection against this in accordance with the procedures set by Viewtel. At this time, if Viewtel recognizes that the reason for the objection is justifiable, Viewtel will promptly resume the use of the service.
  8. In the case of membership withdrawal under this Article, posts posted directly by members and comments registered on public bulletin boards while using the service will not be deleted, so make sure to delete them before applying for membership withdrawal.

Article 9 (Use of Services)

  1. In principle, the service shall be provided 24 hours a day, except in cases where it is not possible for Viewtel's business or technology. However, if necessary, Viewtel may perform maintenance or regular inspection of the service, and in such cases, the provision of the service may be limited for a certain period of time. In case all or part of the services provided free of charge is modified, changed, or terminated in order to use Viewtel's products more effectively, no compensation shall be offered unless otherwise specified in the relevant laws and regulations.
  2. If the contents of a service are upgraded, changed, added, or deleted, Viewtel shall endeavor to notify them on the initial screen of the service or by other means. For the smooth use of the service, users are advised to use the latest version of the service, and any restrictions on the use of all or part of the service arising from non-compliance shall not be compensated unless otherwise specified in the relevant laws and regulations.
  3. Viewtel will strive to provide timely guidance on key matters necessary for using the service. When notifying members, Viewtel will post relevant information on the case by email, in-service notification, or other appropriate electronic means individually or to all members. Viewtel will also post the information on the initial screen or announcement board of the domain's website and application (App) of Viewtel's glucose monitoring system and services.
  4. A user shall comply with the matters prescribed in these terms and conditions, the notice of service, and the user guide, and shall not perform any of the following acts.
    ¨ç Commercial use of services without prior written consent from Viewtel
    ¨è Any change, extraction, duplication, reverse engineering or other similar actions to the service and its accompanying elements
    ¨é Intentionally damaging, weakening or overloading services, malicious use of services, such as dissemination or hacking of malicious software, etc
    ¨ê Other acts in violation of these terms and conditions or laws

Article 10 (Suspension of Services and Notification of Suspension)

  1. Viewtel shall not be responsible for the deletion or loss of personal information stored in the Viewtel service due to national emergencies, service facility failures outside the scope of Viewtel's management, or other force majeure.
  2. If Viewtel is unable to provide normal services due to urgent system inspection, expansion and replacement of the system, natural disasters, or national emergencies, it can temporarily restrict and suspend services, and try to minimize disadvantages to members by informing them of the reason and period of suspension in advance. However, in the case of service interruption due to reasons beyond Viewtel's control (system administrator¡¯s intention, disk failure with no negligence, system down, etc.) and intentionally or negligently caused by others (PC telecommunications companies, key telecommunications operators, system maintenance companies, etc.), prior notice may not be possible and will be announced afterwards.
  3. If a part or all of the services must be permanently suspended due to Viewtel's business judgment, such as the replacement of a new service, the user will be notified 30 days before, and the members will be notified individually.
  4. Please note that if the user's use of the service is immediately permanently suspended due to a clear violation of the law, all benefits and benefits from the service will be extinguished and no separate compensation will be made. At this time, the user may file an objection to this, and if the objection is justified, protective measures such as restoration will be implemented.
  5. Viewtel can divide the service into specific ranges and specify the available time for each range separately, but in this case, the contents will be notified.

Article 11 (Obligation of Viewtel)

  1. Viewtel does not divulge or distribute personal information and sensitive information of users learned in connection with the provision of the service to a third party without his/her consent. However, this shall not apply in cases where it is requested by the relevant agency for investigative purposes under the relevant laws or by lawful procedures under the provisions of the Act, such as at the request of the competent authorities.
  2. In order to provide continuous and stable services, Viewtel will repair or restore related facilities and software without delay unless there is an unavoidable reason when obstruction occurs. However, in the event of a natural disaster, an emergency, or other unavoidable circumstances, the service may be temporarily suspended or stopped. For information on changes or suspensions of services provided by service partners, such as third-party partner apps, please refer to the terms of use and notices provided by partners and contact them individually if necessary.
  3. Viewtel handles user complaints related to the service quickly, and notifies users of the reason and processing schedule if it is difficult to process them quickly.
  4. Viewtel complies with relevant laws such as the personal information protection act of Korea and laws related to the operation and maintenance of services such as the telecommunications secret protection act of Korea and the telecommunications business act.

Article 12 (Obligation of Users)

  1. If the user's actions fall under one or more of the following, Viewtel may delete the post or suspend the use of this service for a certain period of time, and the user shall be liable for damages incurred by Viewtel in connection with such acts, unless intentional or negligent by Viewtel.
    ¨ç Where false information is stated in the membership registration information or posted on the bulletin board provided by the service.
    ¨è Where a post is written that slanders or defames a third party (including individuals and corporations).
    ¨é If it contains verbal abuse against Viewtel's employees or causes other psychological distress.
    ¨ê Where a post infringing on the intellectual property rights and other rights of Viewtel and a third party is stated.
    ¨ë Where a post interfering with the stable operation of the service is recorded.
    ¨ì Where a post containing content that violates public order and social morals is entered.
    ¨í When the service is used for criminal conduct.
    ¨î In the case of obstructing the use of services by other users.
    ¨ï The act of intentionally obstructing the operation of Viewtel's services, transmitting information that may interfere with the stable operation of services, or transmitting advertising spam information against the recipient's express refusal to receive the service.
    ¨ð Any other violation of these terms and conditions or laws, or if View deems it to have reasonable grounds.
  2. In the case of restrictions on use, such as deleting posts or suspending the use of services under the preceding paragraph, Viewtel will notify users in advance of the reasons for restrictions on use, the type and duration of restrictions on use, and how to file objections to restrictions on use. Users may file an objection against this in accordance with the procedures set by Viewtel. At this time, if Viewtel recognizes that the reason for the objection is justifiable, Viewtel will promptly restore the post or resume the use of the service.
  3. Users are not allowed to hack, use in unacceptable ways such as decompiling and reverse engineering, or illegally distribute commercial software. Viewtel is not responsible for the consequences and losses of activities in violation of this, and legal measures such as punishment by related agencies, and users are liable for damages suffered by Viewtel in connection with such acts.
  4. Data sharing and downloading functions within the service are only available at the user's choice, and the user is responsible for this.

Article 13 (Protection of Users' Personal Information and Sensitive Information)

  1. Viewtel places great importance on the protection of users' personal information and strives to protect users' personal information according to related laws such as the Korea Personal Information Protection Act.
  2. The user's personal information is collected and used only to the minimum extent necessary for the smooth delivery of the Viewtel service, and notification or marketing information related to the use of the service may be transmitted to the user's contact information according to the purpose and scope agreed upon by the user. Other details on the protection and processing of personal information can be found at the Personal Information Processing Policy (https://view-tel.co.kr/default/policy/en/privacy.php) ), which is posted separately to be well displayed to users, such as service menus.

Article 14 (Reversion of Rights)

  1. Copyright and intellectual property rights for the Services belong to Viewtel.
  2. Copyright and other intellectual property rights of third-party works provided by Viewtel under the affiliate agreement shall belong to that provider unless otherwise specified in the contract with that provider.
  3. Viewtel's services and any information and materials provided therefor are Viewtel¡¯s properties or Viewtel has the right to use them with the protection by relevant laws and regulations. Information and materials in this section may be used by indicating the source after a written contract with Viewtel, even if they are cited for non-profit purposes other than the purpose of providing services. It prohibits copying, modifying, reprinting, distributing, publishing, exhibiting, transferring, selling or using such information and materials without such permission to produce tangible or intangible goods, services, etc.
  4. In accordance with paragraph 3 of this article, even if a user uses Viewtel's information and materials under a written contract with Viewtel, it is in principle impossible to disclose or provide it to a third party other than the contracting party, and if it violates it, the user shall be liable for damages.
  5. Viewtel grants users the right to use (hereinafter referred to as the "service license") a non-exclusive, retractable and non-re-enforceable limited service (including the use of the service software) if you agree and comply with these terms and conditions. The user may use this service license for the purpose of providing the service only, and may not transfer it to another person or allow reuse. You acknowledge and agree that Viewtel's licensing of this service is a license to use the service only for the duration of your service, and that no further rights are transferred to you, such as ownership and intellectual property rights related to the service. This service license does not apply to the names, brands and logos of Viewtel and its services, and its copyrights, trademarks, patent rights and all other rights are owned by Viewtel and are protected by the relevant laws and regulations.

Article 15 (Exemption)

  1. In the event of damage to the user due to the use of the service, Viewtel shall be liable only in the case and extent to which such damage has been caused by Viewtel's direct attributable reasons. Viewtel shall not be liable for any damages incurred to the user due to any of the following reasons if there is no intention or negligence.
    ¨ç Where it is impossible to provide services by natural disasters or equivalent force majeure.
    ¨è Where there is a disability in the use of the service due to reasons attributable to the user.
    ¨é Any loss or damage caused by the unavailability of the service.
    ¨ê Profits and losses arising or expected to occur due to information and data obtained by the user through the service and similar gains and losses.
    ¨ë Responsibility for posts prepared by users and disputes between users and third parties through the relevant service or its platform.
    ¨ì All other damages incurred to the customer by this service to the extent permitted by the relevant laws and regulations.
  2. De facto or legal defects in services (including, but not limited to, defects related to safety, reliability, accuracy, completeness, validity, conformity to a specific purpose, security, errors and bugs, infringement of rights, etc.) may occur due to Viewtel's irresponsible reasons. Viewtel is not liable for defects in services unless intentional or negligent.
  3. The information provided by Viewtel through the service is for reference to the user and cannot replace medical diagnosis, treat or treatment in any case, and the use of the information is entirely at the user's discretion, and Viewtel is not liable for any liability unless intentional or gross negligence is present.
  4. Services provided by Viewtel to users may include products or services provided by third parties through business partnerships with Viewtel, and the responsibility lies with third parties providing such products or services.
  5. Even as provided in paragraph 4 of this article, Viewtel shall not be liable for any damages, indirect damages, or other damages (including cases where Viewtel or the user has foreseen or was able to foresee the occurrence of the damage) caused by default or illegal activities by Viewtel's negligence (excluding gross negligence).

Article 16 (Damage Compensation)

If the user reproduces, discloses, provides, or uses all or part of the service and its accompanying elements for any purpose other than the use of the service prescribed in this agreement by means of printed materials, electronic storage media, or in violation of the user's obligations set forth in this agreement, Viewtel may claim damages from the user for any damages caused thereby.

Article 17 (Rules of Terms and Conditions Outside)

The interpretation of the terms and conditions and the matters not specified in this agreement shall be subject to individual service terms and conditions or related laws, and matters not specified in the law shall be subject to the business regulations.

Article 18 (Rules of Compliance and Dispute Resolution)

  1. These terms and conditions are authentic in Korean.
  2. The laws and regulations of the Republic of Korea apply to the relationship between the user and Viewtel in relation to these terms and conditions and Viewtel services.
  3. In principle, disputes between users and Viewtel arising in connection with these terms and conditions, such as the use of the service, shall be resolved through consultation between the parties, but if mutual resolution is not possible, the court having jurisdiction over the dispute shall be determined in accordance with the Civil Procedure Act.

Article 1 (Effective Date)

This terms and conditions shall come into effect as of October 1'st 2024.
